Apple's Injunction in U.S court to ban two of Samsung Galaxy Smartphones and Samsung Galaxy Tab 10.1 is halted for the time. The judge Lucy Koh denied the appeal and stated, that “it is not clear that an injunction on Samsung's accused devices would prevent Apple from being irreparably harmed."
Apple, in a petition claimed that Samsung Galaxy S, Samsung Galaxy S II and Galaxy Tab 10.1 violated the design patents, bearing a resemblance to Apple iPhone and iPad. Thus, Apple gained a Sales Injunction in the month of November. However, judge expressed that, this wasn't a final judgement and it will act as an immediate justification. Now, District Judge Lucy Koh denied the sales injunction completely.
Earlier, Apple has been successful in Germany and Australia. The preliminary injunction against the Samsung Galaxy Tab 10.1 is still in place in Germany. The legal battle will not end there. Apple armed with the patent power can fire back anytime in the coming months. They already doing the same with HTC and other Android smartphone makers.
