Apple wins a major victory on Samsung today. A German court banned the selling of Samsung Galaxy Tab 10.1 in European Union.
Samsung is disappointed with the court’s decision and we intend to act immediately to defend our intellectual property rights through the ongoing legal proceedings in Germany and will continue to actively defend these rights throughout the world. The request for injunction was filed with no notice to Samsung, and the order was issued without any hearing or presentation of evidence from Samsung. We will take all necessary measures to ensure Samsung’s innovative mobile communications devices are available to customers in Europe and around the world. This decision by the court in Germany in no way influences other legal proceedings filed with the courts in Europe and elsewhere.
For a couple of months, Apple and Samsung were in cold battle. Both the parties, sued and counter sued each other on various patent and infringement issues. This involves in Apple's patents on aspects of the iPhone / iPad's design and GUI. Now, this winning will somehow makes Apple happy. However, German court's injunction pertains to European Union member states. Apple to request other EU member states to honor the injunction. Samsung is ready to sell the version of Samsung Galaxy Tab 10.1 in Australia and Apple doesn't have an objection.
While going back to the original law suits somewhere took place is April of this year states that Apple requested to block the sale of Samsung Infuze, Galaxy S 4G, Droid Charge, and the Galaxy Tab 10.1. Now then, Samsung has no such restrictions and barriers to sell the product in USA.
