Chipmaker Qualcomm has asked the Chinese court to ban the sales of the latest Apple iPhone XS, iPhone XS Max, and iPhone XR days after it won a preliminary injunction against the company's older smartphone models. The new lawsuit is related to the same case of violating patents of Qualcomm, which includes related to resizing photographs and managing apps on a touchscreen.
Apple, of course, has subverted the ban on sales of its older models. The patent violation is limited to devices shipping with iOS 11 or older software versions, but all new handsets boot iOS 12 out of the box. This allows Apple to continue selling its smartphones - including the banned iPhones - in China. Moreover, the China court did not mention any of the specific device versions that Apple is taking advantage of and is very likely for the company to continue the sale of its latest version.
Moreover, Apple today announced it will be pushing out a software update in China next week to resolve potential issues pertaining to the ban. This update, the company says, will address any possible concerns about its compliance with the order.
Previously, Qualcomm won the initial ban on iPhone models, including iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus, and iPhone X citing patent infringement case, which, according to the company was a legal dispute and it believed that the case would be a win. Also at this point of time, Apple is arguing even if the Qualcomm wins, the case is in no way related to the latest operating system by the company and, hence, would not affect the sale o the new devices.
